The United States Oil Pollution Act of 1990 limits BP's liability for non-cleanup costs to $75 million unless gross negligence is proven. BP has said it would pay for all cleanup and remediation regardless of the statutory liability cap. Nevertheless, some Democratic lawmakers are seeking to pass legislation that would increase the liability limit to $10 billion. Analysts for Swiss Re have estimated that the total insured losses from the accident could reach $3.5 billion. According to UBS, final losses could be $12 billion. According to Willis Group Holdings, total losses could amount to $30 billion, of which estimated total claims to the market from the disaster, including control of well, re-drilling, third-party liability and seepage and pollution costs, could exceed $1.2 billion. As of mid-June 2010, BP's stock had lost more than 40% of its value compared to the period before accident, equivalent to $80 billion in market capitalization. Many have criticized the federal government in the past weeks for not doing enough. The reality is, there is only so much government can do to help, yet a lot they can do to prolong the problem and misdirect the pain. For example, in the interest of doing something, the administration has enacted a unilateral ban on offshore drilling. This is counterproductive. I am proud to co-sponsor legislation to lift that ban. Why punish other oil companies and their hardworking employees who had nothing to do with the disaster and who have better safety records? And, as usually happens after disasters, countless people, even officials in local and state government, have come forward who know what needs to be done and are willing to help but have been stymied by federal bureaucratic red tape as the oil continues to gush. The real problem is not so much a lack of government assistance but government getting in the way of those who have solutions. We witnessed the same phenomenon during hurricanes Katrina and Ike. NEW ORLEANS -- A federal judge struck down the Obama administration's six-month ban on deepwater oil drilling in the Gulf of Mexico on Tuesday, saying the government rashly concluded that because one rig failed, the others are in immediate danger, too. The White House promised an immediate appeal. The Interior Department had halted approval of any new permits for deepwater drilling and suspended drilling of 33 exploratory wells in the Gulf. Press Secretary Robert Gibbs said President Barack Obama believes strongly that drilling at such depths does not make sense and puts the safety of workers "at a danger that the president does not believe we can afford." Several companies that ferry people and supplies and provide other services to offshore drilling rigs asked US District Judge Martin Feldman in New Orleans to overturn the moratorium. They argued it was arbitrarily imposed after the April 20 explosion on the Deepwater Horizon drilling rig that killed 11 workers and blew out the well 5000 feet underwater. It has spewed anywhere from 67 million to 127 million gallons of oil into the Gulf. It is the largest marine oil spill in the history of the petroleum industry. The spill stemmed from a sea-floor oil gusher that resulted from the April 20, 2010 Deepwater Horizon drilling rig explosion. The explosion killed 11 platform workers and injured 17 others. On July 15, the leak was stopped by capping the gushing wellhead after releasing about 4.9 million barrels (780×10^3 m3) of crude oil. It was estimated that 53000 barrels per day (8400 m3/d) were escaping from the well just before it was capped. It is believed that the daily flow rate diminished over time, starting at about 62000 barrels per day (9900 m3/d) and decreasing as the reservoir of hydrocarbons feeding the gusher was gradually depleted. The spill is causing extensive damage to marine and wildlife habitats as well as the Gulf's fishing and tourism industries. Scientists have also reported immense underwater plumes of dissolved oil not visible at the surface. Crews have been working to protect hundreds of miles of beaches, wetlands and estuaries along the northern Gulf coast, using skimmer ships, floating containment booms, anchored barriers, and sand-filled barricades along shorelines.
